A dad has been jailed after insisting on going on a family holiday with his former partner against her wishes after they split up.

Sebastian Ormston disregarded a restraining order by going to Spain with his ex and their kids. During the break and on the flight home, he became drunk and abusive.

He went on to commit further breaches of the restraining order and was already on a suspended prison sentence for possessing cocaine with intent to supply. Now Ormston has been jailed by a judge at Newcastle Crown Court.


The court heard the pair had been in a relationship for around seven years but they split up and Ormston was given a restraining order in January this year banning him from contacting her.

Before they broke up, a family holiday to Spain had been booked for May. Following the end of their relationship, she told him she didn't want him to go on the break but he insisted on going, against her wishes.

John Hobley, prosecuting, said: "During the week-long holiday he became drunk and abusive towards her. She asked him to stop when people around them complained. He was also drunk and abusive on the flight home."

Around a month later, the woman saw Ormston at her neighbour's house so she left to avoid problems, collecting the children from school before returning home later.

Mr Hobley said: "When she got home, he was still present. He demanded money he had given her to provide for the children, including to pay for the holiday to Spain. She refused and he kicked off, accusing her of stealing his bank card.

"He jumped over the fence into her garden, walked into her home and rifled through her cupboard. She left her house to try to de-escalate the situation and went to her neighbour's house.

"The defendant followed her, climbing over the fence into her neighbour's garden." He went on to damage a hinge on his former partner's shed and punched her car.

Mr Hobley said: "He refused to leave the area. The complainant went to her neighbour's house and he attended, grabbed her bag and dragged her across the kitchen."

She made a silent call to the police, during which he warned her not to call officers. When they turned up he fled but was arrested 11 days later after attending a probation appointment.

Referring to a victim impact statement, Mr Hobley said: "She said he made her feel worthless and depressed and concerned the children will copy his behaviour." She added that she was "fed up" and feeling "drained and anxious" because of him.

In October, he breached the restraining order again by contacting her friend, asking her to ask his ex to contact him and relay messages.

Ormston, 33, of Merton Road, Walker, Newcastle, who has three previous convictions, including for breaching a non-molestation order in 2013 and possessing cocaine with intent to supply, admitted three breaches of the restraining order, assault by beating, criminal damage and being in breach of the suspended sentence imposed for the drugs offence.

He was jailed for a total of two years and two months and given a ten-year restraining order. Judge Robert Spragg said there had been 31 domestic incidents recorded with him as the suspect.

Judge Spragg told him: "The restraining order was put in place to protect her. You wilfully and persistently flouted that order. Seemingly you took the view it didn't apply to you."

Katie Spence, defending, said: "It seems it was a planned holiday they went on as a family. He should not have done so.

"He accepts at the time he had not accepted the pair had broken up. He struggled with the relationship breakdown. He feels he has learnt his lesson."
